Can a REALTOR® Discriminate? What You Need to Know in Florida

Fair Housing laws are clear. But discrimination still happens — and knowing your rights is the first step to protecting them.

Let’s answer this clearly.

No… a REALTOR® cannot legally discriminate.

But that doesn’t mean discrimination doesn’t happen.

And that’s where understanding Fair Housing becomes critical… not just for agents, but for buyers and sellers navigating the real estate process.

What Is Fair Housing?

Fair Housing refers to laws that prohibit discrimination in housing based on protected characteristics. In Florida and across the United States, these protections apply to real estate professionals, landlords, sellers, and anyone involved in housing-related decisions.

  • Religion
  • Sex
  • Disability
  • Familial status
  • National origin

How Discrimination Shows Up in Real Estate

Discrimination is not always obvious. It doesn’t always look like someone saying ‘no.’

Sometimes it looks like:

  • Not returning calls
  • Limiting which homes are shown
  • Steering clients toward or away from certain areas
  • Changing how properties are marketed
  • Making assumptions about a buyer’s qualifications

These actions can violate Fair Housing laws… even when they are subtle.

Why This Matters for Buyers

If you are buying a home, you should never have to question whether you are being shown all available options, whether your offer is being presented fairly, or whether you are being treated differently because of who you are.
